Important clarifications regarding MACP Scheme published by DoP&T

Some important clarifications regarding MACP Scheme published by DoP&T today in its website. We have reproduced the contents of the order given below for your information.Highlights of the order:- There are 25 Questions and Answers, which are indicated as Points of Doubts and Clarifications in this order.

All the Central Government Employees Federations, confederations are demanding that Grade Pay of the next Promotional Post to be granted under the new MACP Scheme instead of granting next higher Grade Pay in the revised Grade Pay Hierarchy. It was insisted in the MACP Joint committee meeting, the career progression only means the promotion in the hierarchy and not to a Grade Pay which is not present in the hierarchy of the respective department. But Official side not accepted this demand, still it is pending...

In this order, the norms are required to be fulfilled while granting upgradation under MACPS...
Grade Pay 1800 - 2800 (PB-1) = "Fitness in the Hierarchy"
Grade Pay 4200 - 6600 (PB-2) = "Good"
Grade Pay 7600 and above = "Very Good"

Point of doubt and Clarification...

1. What is Modified Assured Career Progression Scheme (MACPS)?

The MACP Scheme for Central Civilian Government Employees is in supersession of earlier ACP Scheme. Under the MACP Scheme three financial Up-gradations are allowed on completion of 10,20,30 years of regular service, counted from the direct entry grade. The MACPS envisages merely placement in the immediate next higher grade pay as given in Section I, Part-A of the first schedule of the CCS (Revised Pay) Rules 2008, in case no promotion has been earned by the employee during this period.

2. From which date the MACPS is effective?

The MACPS is effective w.e.f. 01.09.2008 or on completion of 10, 20 & 30 years of continuous regular service, whichever is later. Financial upgradation will also be admissible whenever a person has spent 10 years continuously in the same grade pay. (Para 9 of OM dated 19/5/2009)

3. Who are entitled for financial under the MACPS?

The MACPS is applicable to all Central Government Civilian Employees.

4. What norms are required to be fulfilled while granting the benefits under MACPS

The financial upgradation would be on non-functional basis subject to fitness in the hierarchy of pay band and grade pay within PB- 1. Thereafter, only the benchmark of 'Good' would be applicable till the grade pay of Rs.6600 In PB-3. The benchmark will be 'Very Good' for Financial upgradation to the grade pay of Rs.7600 and above. However, where the Financial upgradation under the MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in para 17 of the Scheme, the benchmark for promotion shall apply to MACP also. 5. Whether Pay Band would be changed at the time of grant of financial upgradation under MACPS

Yes. OM.N0.35034/3/2008-Estt.(D) dated 09/09/2010

6. Whether the promotions in same grade would be counted for the purpose of MACPS?

The financial up-gradation under the MACPS is in the immediate next higher grade pay in the hierarchy of recommended revised pay bands and grade pay as given in CCS (Revised Pay) Rules, 2008. However if the promotional hierarchy as per recruitment rules is such that promotions are earned in the same grade pay, then the same shall be counted for the purpose of MACPS.

7. How will the benefits of ACP be granted if due between 01.01.2006 and 31.08.2008

The revised pay structure has been changed w.e.f. 01.01.2006 and the benefits of ACPS have been allowed till 31.08.2008. Hence, the benefits of revised pay structure would be allowed for the purpose of ACPS.

8. Whether adhoc appointment would be counted towards qualifying service for MACPS

No. Only continuous regular service is counted towards qualifying service for the purpose of MACPS. The regular service shall commence from the date of joining of a post in direct entry grade on a regular basis. (Para 9 of the MACPS)

9. Whether State Government service shall be reckoned for the purpose of MACPS

No. Only regular service rendered in the Central Government's Department/Office is to be counted for the purpose of MACPS, as the Scheme is applicable to the Central Government Civilian Employees only. ( MACPS , Para 10)

10. What are the periods included in the regular service?

All period spent on deputation/foreign service, study leave and all other kind of leave, duly sanctioned by the competent authority shall be included in the regular service. (Para 11. MACPS)

11.How is the MACPS to be extended to the employees of Autonomous and Statutory Bodies

Procedure prescribed in OM No.35034/3/2010- Estt(D),Dated 03/08/2010 would be followed by the administrative Ministries/Departments concerned for extension of the MACPS to the employees of Autonomous and Statutory Bodies under their control.

12. Whether the cases of grant of financial upgradation allowed under the ACPS between 01.09.2008 and 19.05.2009, the date of issue of the Scheme are be reviewed?

Yes. Since the benefits of ACPS have been discontinued w.e.f. 01.09.2008, the cases settled between 01.09.2008 and 19.05.2009, in terms of previous ACP Scheme shall be reviewed.

13. Whether the past continuous regular service in another Govt.Deptt. in a post carrying same grade pay prior to regular appointment in a new Deptt. without a break shall be counted towards qualifying regular service for the purpose of MACPS.

Yes. ( Para 9, MACPS)

14. Upto what grade pay the benefits under the / MACPS is allowed?

The benefits of MACPS are being up-to HAG scale of Rs. 67000 - 79000/- (DOPT's O.M.No.35034/3/2008-Estt.(D) dated 24.12.2010)

15. How the cases of pre-revised pay scales (Rs.5000-8000 & Rs.5500-9000 and Rs.6500-10500 & Rs.7450-11500) merged w.e.f. 01.01.2006 are to be decided under MACPS?

The cases would be regulated in accordance with para 5 of Annexure-I of MACPS. The Ministries/Departments are expected to re-organise cadres and frame common RRs for the post in merged scales.

16. Whether 'Non-functional Scale' of Rs.8000-13500 (revised to grade pay of Rs.5400 in PB-3) would be viewed as one financial upgradation for the purpose of MACPS.

Yes, in terms of para 8.1 of Annexure-I 01 MACPS dated 19.05.2009.

17. Whether time bound promotion' scheme including 'in-situ promotion' scheme can run concurrently with MACPS.

No. ( Para 13 of MACPS)

18. Whether Staff Car Drive Scheme can run concurrently with MACPS

DOPT vide O.M.No.35011/03/2008-Estt.(D),30/07/2010 has extended the benefits of MACPS to Staff Car Drivers as a fall back option

19. Whether the placement of erstwhile Gr. D employees as Staff Car Driver, ordinary grade would count as a promotion?

No. The model RRs for Staff Car Drivers provide deputation/absorption as a method of appointment for erstwhile Gr. D employees . The placement as staff Car Driver is not in the hierarchy hence the same would not be counted as promotion under MACPS. The regular service for the MACPS would be from the date of appointment as Staff Car Driver.

20. Whether designation classification or higher status would change on account of financial upgradation under MACPS

There shall be no change in the designation classification or higher status on grant of financial upgradation under MACPS, as the upgradation under the Scheme is purely personal and merely placement in the nexl higher grade pay. (Para 16 of Annexure-l of MACPS refers)

21. If a financial upgradation under the MACPS is deferred due to the reason of the employees being 'unfit' or due to departmental proceedings, etc, whether this would have consequential effect on the subsequent financial upgradation.

Yes, this would have consequential effect on the subsequent financial upgradation, which would also get deferred to the extent of delay in grant of financial upgradation. ( MACPS, Para 15)

22. Whether the stepping up of pay would be admissible if a junior is getting more pay than the senior on account of grant of financial upgradation under MACPS.

No stepping up of pay in the band or grade pay would be admissible with regard to junior getting more pay than the senior on account of pay fixation under MACPS. (Para 10 of OM dated 19/5/2009)

23. Whether the regular service rendered by an employee if declared surplus in his/her organisation and appointed in the same grade pay or lower grade pay shall be counted towards the regular service in a new organization for the purpose of MACPS

Yes. (refer para 23 of Annexure-l of MACPS)

24. In case of transfer including unilateral transfer own request, whether regular service rendered in previous organisation/office shall be counted alongwith the regular service in the new organization for the purpose of MACPS.

Yes. OM No.35034/3/2008-Estt(D) dated 01/11/2010

25. If a regular promotion has been offered but was refused by the employees before becoming entitled to a financial upgradation under the MACPS, whether financial upgradation shall be allowed to such a Government servant.

If a regular promotion has been offered but was refused by the Government employee before becoming entitled to a financial upgradation, no financial upgradation shall be allowed and as such an employee has not been stagnated due to lack of opportunities. If, however, financial upgradation has been allowed due to stagnation and the employees subsequently refuse the promotion, it shall not be a ground to withdraw the financial upgradation. He shall, however, not be eligible to be considered for further financial upgradation till he agrees to be considered for promotion again and the next financial upgradation shall also be deferred to the extent of period of debarment due to the refusal.( Para 25 of MACPS)

    what is the proceedure of bench marks if a person completed above 20 years service and from the date of maturity having Ist three ACRs/APRs are Good/Very Good and 4th is having some adverse entries and 5th is Good to grant IInd upgradation under MACP to a person drwaing grade pay Rs.4200/- and will be granted grade pay Rs.4600/-

  5. I an joined as a Gr D Staff on 8.9.1988. One financial upgradation given by our dept whenever Sr. Cum fitness promotion not to be entitled. in the year 2002 get promotion by the Limited departmental examination. so before promotion financial upgraded pay is to be counted for MACP or I get 2nd MACP w.e.f. 1.9.2009 sir ?

    Refer DOPT No. 35034/3/2008 -Estt(D) dated 9.9.10, vide which point of doubt has been clarified at Sr. No. 2 , which reads as follows
    Point no.2- Whether the benefits of MACP would be allowed to the government servant , who have been later on inducted in the organised group A service.
    Clarification-No. The benefits under MACP is not applicable to Gr. A officers of organised group A service , as the officers under organised Gr A services has already been allowed parity of 2 years on non-functional basis with the officers of Indian Administrative Service(IAS)
    Clarification sought :- Inspectors of Central Excise promoted in rank of Assistant Commissioner (IRS), Group A service , who have not been allowed parity of two years on non-functional basis as given with the officers of Indian Administrative Service in that case officers from the grade of Inspectors of Central Excise inducted in to Group A Service as IRS would be entitled for 3rd financial upgradation or not with effect from 1.9.2008 under MACP Scheme.

  7. clearification regarding if an official appointed in old scale i.e. 260-430 and get 1st ACP on 09.08.1999 in the scale of Rs. 4000-6000 and 2nd ACP on 23.04.2005 ub tge scale of Rs. 4500-7000. The official has not got any promotion in his service tenure completing 30 yrs service. Can he get 3rd ACP in 28 years service? Kindly give clearification in this matter and under which rule.

Sir,I was appointed as Jr.Hindi Translator- Pay Scale Rs.425-700/-PM in theOrdnance Factories Organization on 10.05.1980,Promoted as as Hindi Officer Grp.B Gazetted on 23.02.1989 in the Pay scale 2000-3500/-PM.(vth CPC-Rs.6500-10500/-) Awarded ACP Rs.7500-12000/-PM.w.e.f.10.05.2004. On implementation of VIth CPC due to up-gradation of Hindi Officer post in Group A in the PB-3 Pay Band Rs15600-39100 with Grade Pay of Rs 5400/-PM my pay was fixed toRs.18140 +5400/- and as on 1.7.2008 Rs.20330+5400/-PM The benefit of one ACP is denied, since my 19 years Junior Hindi officers are also getting PB-3 Scale + Grade pay of Rs.5400/- then where stands my 12 years earned ACP & seniority of 20 years so far the pay packet is concerned?
    Sir, Since 23.02.1989(20 years) as on 23.02.2009 I did’nt get any promotion or Financial up-gradation. As per the Illustration table28(A)(1)&(ii) given in the DOPTA’s Order No.35034/3/2008-Est(D) dated 19.05.2009 one couold get 3 financial up-gradation in 28 years of service, whereas I have completed 28years 09months as on 23.02.2009. I superannuated w.e.f. 30.09.2009.
    Kindly clarify the rule position in my case whether I shall be continue to draw less salary/pension then my juniors who were enjoying the higher Grade pay of Rs 6600/-w.e.f.1.1.2008 moreover,Is it not justified that I should get my 2nd MACP w.e.f.
    01/09/2008-Rs 6600/- and Rs.7600/- w.e.f.23/02/2009

Sir, I was appointed as Sup 'A' Gd (Tech) Basic Rs 425/- - 700/- PM in DGAQA,in 1979 and 1994 i am appeared in same department as a direct vacancy Foreman as Gp 'B' Gaz and selected as FM Basic Rs 2300 - 3500/- old scale in 1994. Now i am completed 33yrs regular service without any service break in same dept DGAQA. our Derpt not given MACP 10,20,30 benifit to me why not known ? my juniors in service and also juniors in post they got 3rd MACP GP -Rs5400/- but my GP Rs 4800/-. HQ still kept my case last 1& 1/2 yrs. No reply received till date. Please give yr suggestion kindly give reply and advise me. what is wrong in my case ?

  10. About MACP: - I want to know about Group 'D' employees. First I am Group D Employee.
    But in the same department direct requirement for LDC and first ACP in 2000 and one promotion in 2004.
    In MACP I am entitled or not.

    Hello Sir,

    I am working in a Central Govt. Office In Lucknow as Hindi translator in the scale of 5000-8000 since 1990. I was granted ACP in 2002 in the scale of 5500-9000. My scale was revised as per 6th CPC in the revised pay structure of PB-2 9300-34800 +GP 4200. Under MACP I was granted GP 4600 with effect from 1-Jan-2006.

    Ministry of Finance, Dept. of Expenditure vide their OM no. F.1/1/2008-1C, dated 24-11-08 had placed the post of junior hindi translator in the scale of Rs.6500 – 10500 PB2 w.e.f. 1-1-2006. Further Ministry of Finance Govt of India has granted grade pay of 4600 in the revised payband PB2 to posts that existed in the pre-revised scale of Rs.6500-10500 as on 1-1-2006 vide their order no. F.1/1/2008-1C dated 13-11-2009. Accordingly I think I must be given GP of 4800 w.e.f. 1-1-2006.

    Kindly clarify whether the above said order of 13-11-2009 is applicable to Jr. Hindi Translator or not. Kindly reply at the earliest possible as it is very urgent and I am waiting for it eagerly.

  14. I RETIRED AS ASSISTANT DIRECTOR FROM MHA ON 30.9.2006. I JOINED SERVICE ON 20.06.1969. I WAS GRANTED ONE ACP ON 20.8.1999 OF THE PRE-REVISED SCALE OF 10000-15200. MY REGULAR PROMOTION AS ASSISTANT DIRECTOR WAS GIVEN IN MARCH 2004. AM I ENTITLED TO ANY BENEFIT OUT OF THE NEW MACPS SCHEME OF CENTRAL GOVERNMENT.

  15. I am a Constable in CISF appointed on 2nd July 1994 and got ACP benifits of Head Constable on 2nd July 2006 in prerevise pay. After pay revision under 6th Pay commission my pay by adding 3% of basic and grade pay 2400 whereas as per Section II of Part-A of First Schedule of 6 CPC the minimum pay of Head Constable is Rs 7510 and 2400Grade Pay. Please clarify whether I am entitled for minimu pay of Head Constable Rs.7510+2400GP or not. In this regard a clarification has been issued by Railway Board vide S.No.PC-Vl/270 No.PC-VI/2010/l/RSRP/1RBE No.115/2011New Delhi, dated.16.08.2011

  16. My friend Section Officer got MACP financial upgradation in this year Jan 2011 in the pay band of 9300-34800 from grade pay 4600 to grade pay 4800 and got pay fixation as per rules. Now he got regular promotion to the post of Admin Officer in the pay band of Rs.15600-39100 with grade pay of Rs.6600. So can anybody clarify that whether he will be admissible for pay fixation for his regular promotion after MACP up-gradation fixation ?

I was recruited as a steno typist on 25.4.1980 and promoted as a Jr.Scale steno after qualifing the test on 3.10.1982 but the post of steno typist was abolished to Jr.Stenographer after the recommendations of 4th central pay commission in 1986. After that I was promoted as a Sr.stenographer after qualifying the test on 5.8.1989. After the recommendatins of 5th Central pay commission the post of Sr.Stenographer was abolished to Personal Assistant. On 5.8.2001, I was given Ist ACP in which I was given pay scale of Personal Secretary and not the designation. Here I want to say that according to me I have availed two promotions, First Stenographer to Personal Assistant and second pay scale of Personal Secretary without designation and the 3rd ACP is due to me. Kindly suggest me, I am right or wrong. Thanks.

    I joined in KVS as LDC on 31-07-1991 and accordingly I got 1st ACP on 31-07 2003. Now I am elligible for 2nd MACP on 31-07-2011. But my promotionorder as UDC has been issued on 27-07-2011 and last date of joining for this post was 16-08-2011, but I refused the promotion on 16-08-2011. Now am I illegible for 2nd MACP on 31-07-2011. Please clarify.

    i was appoint as a auditor in the year 12/12/1983,pay revised in the year 01/.9/1991 as sr.auditor,my acp was due on 01/12/2007,but i have no intimation of departmental exam and not sitting in the said exam,due this my department refuse to give acp on 01/12/2007,on 01/09/2008 1st macp has been given.i am requested several time for second macp as my continue service has been completed 27 year.please help me in this matter with clarification.

    i am a central gov. employee.two macp as on dated 01/09/08 and 18/01/2010is given to me.no information regarding macp is given to me by the office for the fixation of macp.after fixation i found that both the two macp has given to me but national increment of 2010 is not given due to fr22 form.i donot know about this form.so i have not filled.but i am in a loss of one increment.office is not ready to give the national increment of 2010.
    sir please help me .what i do is the any rule to again fixation of macp or anything else please do something

    I am working in DRDO since 07 April 2000. I have not got any promotion even after more than 11 years are passed.Initially I was appointed as Technical Assistant ‘A’ which was re-designated as Senior Technical Assistant ‘A’ in Pay scale Rs. 5000-150-8000/ & further in six pay commission the Name post was again changed as Senior Technical Assistant ‘B’ with Grade Pay 4200/- & Scale 9300-34800/-
    I belongs to DRTC cadre of DRDO, where there is provision of promotion by assessment (fixed percent of total appeared candidate) after every five years. But I have not got promotion even after 11.5 years of regular service. (Actually I got promotion in 2007 after 7 years of service as STA ‘A’ (scale Rs. 5000-150-8000/) to STA ‘B’ in Pay scale of Rs. 5500-175-9000/ which was again merged with 5000-8000 scale in six pay commission & hence promotion was nullified). My question is:
    1. Whether MACP scheme also applicable to DRTC cader of Defence R&D Organisation’s civilian employee?
    2. I have completed 10 years of regular service as STA ‘A’ & STA 'B' in April 2010 in same grade pay 4200/-. I want to know whether I am eligible for next higher grade pay i.e. Rs. 4600/-or not?

    Clerk in the pay scale of 4000-6000 (5th CPC)since Dec.2001. My date of joining 19.12.1989, My scale was revised as per 6th CPC in the revised pay structure of 5200-20200 + Grade Pay 2400. I should get my 2nd MACP w.e.f.
    1/12/2009. Kindly clarify and advice accordingly next pay scale + grade Pay (I am Graduate)

  29. Sir, I joined as PA in Dept. of Posts, India in pay 4000-100-6000 in 7.10.1997 and got 1st MACP i.e PB-I, G.P 2800-. Now i have got promotion APM (accounts) LSG cadre and transferred, which is same Grade Pay i.e 2800-.
    In this regard i want to know what is the financial benefit under this provision, may kindly be intimated.

  30. Upgradation in Revised Scale due to merger of three pre-revised scales
    Dear sir,
    I would like to inform you that I have joined in February, 1987, got IInd MACP w.e.f. 1/2/2007. As on 1/1/2006 I was in pre-revised scale of Rs.5000-8000 with a basic pay of Rs.6800/- As per 6th pay my fixation was done in pay scale of Rs.9300-34800 in Pay Band of Rs.12,650/- with Grade Pay of Rs.4600/-. Till date I have not received any promotion / not received even a single rupee payment of Arrears due to implementation of 6th pay commission.

    As per Govt.of India, Ministry of Finance, Dept. of Expenditure, Implementation Cell Order No.F.No.1/1/2008-IC dt.13th November,2009 i.e. Grant of the revised pay structure of grade pay of Rs.4600/- in pay band PB-2 to posts that existed in the pre-revised scale of Rs.6500-10500 as on 1/1/2006 due to merger of the three pre-revised scales of Rs.5000-8000, Rs.5500-9000 & Rs.6500-10500, ssome posts which constituted feeder & promotion grdes would come to lie in an identical grade, granted higher grade pay of Rs.4600/- to these three posts, being upgraded to the next higher grade in pay band PB-2 wwith grade pay of Rs.4600/- corresponding to the pre-revised scale of Rs.7450-11500 w.e.f. 1/1/2006

    Accordingly my pay fixation should be made in pre-revised pay scale of Rs.7450-225-11500 into the corresponding Revised Pay Scale of Rs.9300-34800 in Pay Band of Rs.13,860/- with Grade Pay of Rs.4600/- w.e.f. 1/1/2006 as per 6th pay commission.Now the problem is our Accounts Dept. is not accepting & not doing Pay Fixation based on this Govt.order dt.13th November,2009.

    You are, therefore, requested to check / inquire with the Relevant / Concerned Govt. Authorities / Ministry of Finance, Dept. of Expenditure about my pay fixation as per guidelines of this Govt.order dt.13th November, 2009 on top priority basis , so as to enable me to get my right, because I am in loss of Huge Amount due to non-acceptance of Govt.order / pay fixation
    Pl. treat this matter as most urgent and take up this matter on top most priority basis.

  32. What is the next ACP scale of Rs.6500-10500 after completion of 12 years as per 5th CPC.

  33. Now ACP is gone and MACP replaced. In MACP your pay will be enhanced after 10 years. Then the pay scale will not be enhanced. Only grade pay will be changed and the basic pay will be fixed as per the MACP Rule. IF you have a grade pay of Rs. 4200 the Grade pay will be 4600. If your present grade pay is 4800 your grade pay will be 5400.

    But in ACP your pay scale will be increased to the next pay scale. 7450-225-11500 or 7500-250-12000 as per your pay structure.

I was appointed as Jr.Clerk on 11.5.1983 and I got the promotion as Sr. Clerk on 17.6.1988 & I also got the IInd ACP on 11.5.2007 after completion of 24 years of service and annual incrementdue in the month of June 2007. As per para 6.1 of MACP I opted 6th CPC from 1.7.2007 i.e. after IInd ACP and annual increment in the month of June 2007, but my department has given me 6cpc from 11.5.2007 instead of 1.7.2007. Thus I could not get the benefit of increment due on 1.7.07 and I got the next increment on 1.7.2008. I requested my department to fix my pay w.e.f. 1.7.2007 instead of 11.5.2007 and also give me one increment on 1.7.2007. Please clarify whether I am eligible for increment on 1.7.2007 or not.

  38. as adirect udc i got 1st acp on 9.8.99 against p.r.o (4500-7000) &2nd acp on 2.5.2001 against office supdt.(5500-9000). p.r.o post redesignated & upgraded to assistent(5000-8000) w.e.f 11.2.2004.please clarify whether i am entitled to 2nd macp ignoring my 2nd acp as my 1st scale up graded and later on merged with other scales ln 6th cpc as per para-5 of annexure -1 of macp order.
